Initially, it was believed that Daniel's arrest was related to multiple probation violations, as in the days leading up to his arrest, Daniel defrauded a Buffalo Wild Wings, and admitted to viewing exploitive material of children. However, according to a call made to his manager, Clark, Daniel was arrested for the several terroristic threats he had made over the past year at the time. This was the fifth time Daniel had been arrested in 2024 alone, with the most recent occurring less than a month prior. Unlike previous arrests, Daniel is ineligible for bond, and given the severity of the charges, there is a possibility he will never be granted bond.

At the time of Daniel's arrest, it was believed that his manager, Clark, had been apprehended by authorities at his job due to his association with Daniel over the previous 10 months. However, it was soon revealed that Clark and members of Daniel's management were investigated by authorities who sought information about threats Daniel had made. Afterward, Clark officially resigned from being Daniel's manager and admitted to lying about his entire existence to him. This aforementioned call was speculated to have been the last contact Daniel had with the outside world, but this would soon be proven false, as Clark continued to communicate with him months later; however, there has been no communication since Daniel's transfer to Springfield.

Following this, Daniel's contact with the outside world has been through sporadic phone correspondence, which was suspended for nearly four months until September. He was in contact with Lil Sippy and Clark while in FCI Englewood through phone calls, emails, and letters. During his two brief stays at two correctional facilities in Oklahoma, he was in touch with Clark via phone calls. However, since his transfer to MCFP Springfield in late December 2024, all communications have been strictly through letters, although it appears that all communications have ceased.

He was held in a mental health facility for evaluation and was ordered to be institutionalized on July 19 after being found incompetent to stand trial.

On December 6, 2024, Daniel informed Lil Sippy that he was to be transferred to the United States Medical Center for Federal Prisoners, or Springfield, in the following week. He was released from Englewood four days later and was transferred to Cimarron Correctional Facility in Oklahoma, where he stayed for two weeks. On Christmas Eve, he was transferred to Grady County Detention Center for unknown reasons, and three days later was transferred to MCFP Springfield for further mental health evaluation. Daniel has undergone several competency restoration and mental health evaluation processes since his incarceration at MCFP Springfield, and has remained there ever since. The most recent one concluded in November 2025, with Daniel's next appearance in court set to be an evidentiary hearing scheduled for January 2026. Whether or not Daniel will remain institutionalized or be free to roam the streets once more afterwards is uncertain.

This is one of the most significant events in Daniel's life, considering that he is currently at risk of being imprisoned for up to 65 years if found guilty on all charges, or possibly see himself institutionalized for the rest of his life. Many see this as the final blow, with his plot armor truly breaking. It has also become the most publicized aspect of Daniel's life thus far, as multiple social media accounts and news articles have covered the situation as it unfolded. The Second Jail Arc is the longest period of Daniel being incarcerated, followed by the November 6th Arrest.
On January 13, 2026, Daniel was transferred out of MCFP Springfield and placed in the Federal Transfer Center in Oklahoma City, Oklahoma. Three days later, he was returned to FCI Englewood. He had a court hearings on January 22 and February 3, 2026 on his competency. Speedy trial calculations ended on February 9, 2026, and on March 3, 2026, Daniel was deemed competent to stand trial. He is now awaiting trial, which is scheduled for April 20, 2026. It remains uncertain whether Daniel will continue to be institutionalized or be released. A pretrial hearing is set for April 9, 2026.

During the summer of 2023, a Secret Service agent named Daniel MacDougall began investigating Daniel following several terroristic threats he had made, namely one in which he threatened to blow up the White House. This threat in particular came right on the heels of Daniel having had a destructive meltdown in a Walmart after having his dog taken from him. Following this, Daniel would have multiple meetings with MacDougall, including one notable encounter where he met with MacDougall and an associate of his.Despite being repeatedly warned by a legitimate Secret Service agent to cease making threats against people, businesses, and government agencies, Daniel refused, continuing to make threats, even making threats against MacDougall himself. As a result, a case was built against Daniel, which eventually led to his arrest. Law enforcement interrogated both Clark, his then-manager, and members of Daniel's management to verify the threats he had made over the years. These testimonies provided the final pieces of evidence necessary for Daniel's arrest.

On April 25, 2024, a warrant was issued for Daniel's arrest. This was thought to be due to Daniel having violated his probation multiple times, even before the issuing of said warrant. This notion was only exacerbated by the fact that only two days after this warrant was issued, he was kicked out of a Pumphouse restaurant by authorities on April 27, 2024, defrauded a Buffalo Wild Wings the next day, and on his YouTube community tab, claimed to have viewed illegal material of children.

On the evening of April 29, Daniel became inactive on all of his social media accounts, with his last post stating that he was on the bus back to Boulder. However, the next morning, he posted on TikTok that he was on his way to the probation meeting, which would be his last social media post before his arrest.

Daniel is well known for making terroristic threats via social media and is speculated to have made over 100 of these threats since 2021. This habit of making threats appeared to escalate in the months leading up to his arrest. A prime example of this trend can be seen in the April 6th Meltdown, in which Daniel repeated the phrase "bomb you!" and "kill you!" threatening to vandalize several government buildings. Even more, in January of the same year, Daniel threatened to carry out a mass shooting against a hospital after having been kicked out.

These threats would not serve him well in the long run, as the Colorado Police Department was slowly building a case against him, charging him with seven counts of threats, which carries a maximum sentence of 65 years.

In the indictment calling for Daniel's arrest, each threat Daniel made that contributed to his arrest was stated, most notably one wherein Daniel threatened to bomb a non-profit organization. This was soon discovered to be the Developmental Disabilities Resource Center, or the DDRC. The DDRC is a non-profit organization that previously helped house Daniel. While the reason behind this threat is unknown, Daniel's threats led to the building being evacuated and searched by bomb-sniffing dogs. The case also included threats to Colorado University and an unspecified state government building. These threats were posted to his Community Tab.

On May 3, Clark, Daniel's former manager, reported in a Discord server that police officers had come to his place of work. Almost instantly afterward, Clark went offline. It was at first assumed that he had been arrested due to allegedly being an accomplice to all of Daniel's threats, as well as having had contact with the Secret Service agent who got Daniel arrested in the first place. This was later proven to be false.

The witnesses were Bob Proctor; Greg Suarez, CEO of Golden Fiduciary and trustee for Nancy Shimer's trust; Mandi Doryland, a Highlands Ranch based counselor who likely previously worked with Daniel; Ian Thomson, CEO of Daniel's caretaker company and former case manager; Jodie Marquez, operations director for Roundup Fellowship and an additional case manager; Alicia Cho, a psychiatric expert; and Tiffany Montano, Daniel's former therapist.

March 2026 Competency Ruling & New Attorney
On March 3, 2026, a month after the hearing, Judge Regina M. Rodriguez ruled that Daniel was mentally competent to stand trial following 20 months (1 year and 8 months) of institutionalization and competency restoration efforts. Daniel disputed that his competency had been restored. The case was finally set to proceed to trial, which is scheduled for April 20, 2026. He will have a pretrial hearing on April 9, 2026.

Dr. Katlyn Hanson diagnosed Daniel with Level 1 autism spectrum disorder, an unspecified schizophrenia spectrum and other psychotic disorder. She reported that although Daniel demonstrated an understanding of the charges against him and the potential consequences, he tended to minimize the seriousness of the allegations and she was concerned about his ability to assist his attorney in his defense. When Daniel arrived to MCFP Springfield in December 2024, he remained grounded in his beliefs that he was dating Grace, and would even constantly talk about him and Grace with staff at Springfield and his defense. Dr. Katlyn Hanson stated that this delusional beliefs were strengthened by the trolls who interacted with him during his stay in jail, claiming that he received prison mail at Springfield containing screenshots of text messages between him and fake Graces. By February 2025, Daniel began taking antipsychotic medication, which reduced his delusions, and soon enough, he finally acknowledged that Grace had nothing to do with his case.

Dr. Mark Mills testified that Daniel could not be fully restored to competency because his cognitive deficits come from both his autism and borderline intellectual functioning, which are considered untreatable. While his delusions improved with the antipsychotic medication and structured treatment at Springfield, Dr. Mills emphasized that Daniel's autism was the controlling diagnosis, preventing him from fully understanding or interacting with his defense team, or recalling information about the threats he made at the time. Dr. Mills also further noted that although Daniel preferred to be found competent and go to trial, his preference likely reflected his cognitive limitations and tendency to agree rather than a fully informed understanding of the legal proceedings, and that he would be unlikely to recall or explain his mental state at the time he allegedly made the threats.

Daniel's mental health history was also documented extensively. The document indicated that he had been hitting himself and punching holes in walls since at least 2011, and that he had been hospitalized twice for these behaviors, once in 2017 and again in 2023. Daniel was also reported to have hit his head in FCI Englewood out of frustration. In 2011, Daniel's mother shared that he had a "non-accidental head injury" at three weeks old and had a seizure at five months. Daniel has also claimed that his mother hit him in the head with a hammer when he was eight years old, though the accuracy of this claim is uncertain. His IQ was reported to be 72, which is slightly above the typical threshold for an intellectual disability.

Daniel no longer qualifies for a free attorney, and his previous attorney, Jared Westbroek, withdrew from the case. Daniel was subsequently reassigned to Jeffrey Feiler, who had represented him the previous year.
