Second Jail Arc: Difference between revisions

It was originally thought that Daniel's arrest was due to him violating probation several times, as in the days leading up to his arrest, Daniel [[Buffalo Wild Wings ejection|defrauded a Buffalo Wild Wings]], and admitted to viewing exploitive material of children.<ref>[[:File:Daniels Admission.png]]</ref> However, according to a call made to his manager, [[Clark]], Daniel was arrested for the several terroristic threats he had made over the years which could land him in prison for several years. This was then confirmed by leaked documents which revealed that Daniel had been charged with seven counts of threats, which carries a maximum sentence of 65 years.     

This was the fifth time Daniel had been arrested in 2024 alone, and he had been [[April 2nd Arrest|arrested just 28 days prior to this]]. This time around, Daniel is ineligible for bond, and there is a chance he will never make bond due to the severity of his charges. Since his arrest, Daniel's only contact with the outside world has been through phone correspondence, though this appears to have ceased permanently.     

Despite being told multiple times by a legitimate Secret Service agent to cease making threats against people, businesses, and government agencies, Daniel refused, doubling down by making threats against MacDougall himself.<ref>[[April 6th Meltdown]]</ref> Due to this, a case was built against Daniel which eventually led to his arrest. Law enforcement interrogated both Clark and members of Daniel’s [[management]] “team” to confirm threats he had made over the years. This ended up being the final pieces of evidence needed to arrest Daniel.   

On April 25, a warrant was issued for Daniel's arrest. This was thought to be due to Daniel having violated his probation multiple times. This notion was only exacerbated by the fact that only two days after this warrant was issued, he was [[List of places that have banned Daniel|kicked out]] of a Pumphouse restaurant by authorities on April 27,{{Citation Needed}} and the next day, he was kicked out of [[Buffalo Wild Wings ejection|Buffalo Wild Wings]] after defrauding the restaurant.  

On the evening of April 29, Daniel became inactive on every one of his [[Social Media Accounts|social media accounts]], with his last post saying that he was on the bus back to Boulder.<ref>https://www.youtube.com/post/UgkxsS17QYOV0UL9Eka2f4uORLmzDC1YXhJQ</ref> [[File:April30thBookingInfo.png|thumb|"Ladies and gentlemen, we got him."|left|350x350px]]Daniel is well known for making terroristic threats via social media and is speculated to have made over 100 of these kinds of threats since 2021. This habit of threat-making appeared to escalate in the weeks preceding his arrest. A prime example of this trend can be seen in the [[April 6th Meltdown]], in which Daniel repeated the phrase "bomb you!" and "kill you!," as well as threatening to vandalize several government buildings. Daniel also made numerous threats against [[Bob Proctor]] on his YouTube community tab during this time. Additionally, Daniel [[January 26th Hospital Incident|threatened to commit a mass shooting at a hospital]] after having been kicked out for loitering in January of the same year.

These threats would not serve him in the long run, as the Colorado Police Department would build a case against him, charging him with 7 counts of threats, which carries a maximum sentence of 65 years. In the indictment calling for Daniel's arrest, each threat Daniel had made that contributed to his arrest was stated, most notably one wherein Daniel threatened to bomb a non-profit organization which was soon discovered to be the Developmental Disabilities Resource Center (DDRC). The DDRC is a non-profit organization that helped Daniel attain housing in the past, and while the reason behind this threat is unknown, Daniel's threat led to its building being evacuated.  

As mentioned in the calls with Clark, Daniel was assigned a public defender due to him not having the means to obtain a lawyer. It is unknown when he was assigned, but Daniel's public defender would soon be identified as '''Jared Scott Westbroek'''. According to Daniel, his public defenders main argument would be that due to Daniel's inability to actually hurt people or create/use explosives, the charges he was facing were false.  

On the 10th of May, right before Daniel's court hearing, documents were found that detailed Daniel's public defender, Jared, making a motion for Daniel's immediate release. Ironically enough, according to a detention order signed by Judge Norman Reid Neureiter, Daniel requested to be released just a day before this on May 9th. These documents asked for Daniel to be put under GPS tracking, as well as being put under mandatory mental health treatment. This documents also mentions putting Daniel into a halfway house, where he would presumably stay if he were to come out of jail, which has not happened yet.
