Daniel called Clark from Cimarron on December 23, 2024. During the call, Clark is in a restroom at a gas station and gets interrupted at the end of the call. [1] This was the second out of two calls that took place in Cimarron.

Daniel: Hello?

Clark: Hi Daniel.

Daniel: Hey, so I got, um, good news.

Clark: OK, OK, what do- what we got?

Daniel: So yesterday the US Marshals, the Marshals Service, US Marshals were here at the jail.

Clark: Geez!

Daniel: Um, somebody that works for the US Marshals, they answered questions for me and made any issues going on at the jail. Um, any issues with staff at the jail, um, stuff like that. So I told them about the issue with my public defender and how I got deemed incompetent. I just kind of told them, like, I’m having issues with my case, OK? But what they did tell me, ‘cause I told them as well about the, uh, if I’m not in Springfield on the, um, 31st which is exactly what I was told, was I have to be in Springfield, that’s what my public defender said. And then if I’m not, my case will get dropped. The US Marshals Service told me that it’s in the words that I have to be at Springfield because I’m at Oklahoma, um, at Cimarron and I’m, um, also in transfer. If they never said anything about transfer and they’re saying I have to be at Cimarron, or I have to be in Springfield which I’m clearly not, then they will drop my case and they’ve seen this type of thing before. They’re saying my public defender and the prosecutor does not drop my case, that’s a violation of the 4th amendment. I’m not quite sure what the 4th amendment really is without looking up the, all the amendments, but currently…

Clark: I think it’s a cruel and unusual punishment.

Daniel: Yeah, uh, I think because- and then there’s also like, I guess something that has to do with words or something like what people are saying, so it would be going against their word. Even though I’m in transfer, they should have either told me to be in transfer which they never said, and they also said, um, that the US Marshal service told me that I would also have to um, oh my God… if they really want me to be at Springfield, they could have done it this week.

Clark: Yeah. Did you talk to the Marshals about like, your past situations and getting like, trolled in the prison and people like, assaulting you or whatnot?

Daniel: Yes I did, and they said that that should not be going on and that also counts as a cruel and unusual punishment because they are also dropping all the Prius (threats) that I’ve ever put out, they’ve dropped, um, for the harassment and reports that I put in from the correction officers themselves, they’re all getting dropped. Um, and so, the thing is they’re just not caring like they really should, um, and they’re not separating, if anything they should separate. You see what I mean?

Clark: I agree.

Daniel: The- and they’re not even doing that. There’s no resolution, there’s no nothing. But the good news is I told Bob yesterday that we should start going ahead and planning for my release. Um, Bob told me that he is still paying my phone bill.

Clark: That’s good.

Daniel: So, that’s a good sign because I must be getting out soon because he was wanting to be paying my phone bill.

Clark: That’s true, he has hope. He has hope.

Daniel: Right. Um, so, I told him hopefully I’m out in January, I don’t know. Um, but at this point, I don’t think they can continue to hold me because they keep saying they’re dropping the case, they keep saying all this stuff, they’re not doing it so at this point, even the Marshals Service told me it’s cruel and unusual punishment. Um…

Clark: Yeah, why would they take you to Oklahoma for no reason if they weren’t gonna take you to Springfield? That makes no sense.

Daniel: They- what they should’ve done is because I know this is the transfer- because they don’t do direct flights for some stupid reason. I don’t know, but they don’t do direct flights. They should have just planned this earlier. [another inmate laughing] That’s what the US Marshals Service is saying. If they really wanted me in Springfield by the 31st, they would have already planned it before the holidays.

Clark: Geez, OK, OK.

Daniel: Um, and then not only that, um, I decided that because the situation with me and Grace, and what’s going on with that. I’ve kind of decided that we’re going because Grace said that we were engaged and um, that was before I got arrested. We were looking at houses, I’ve decided once I get out, I’m going to try to just leave off where- or start off again where we left off. I’m just gonna start looking at houses again and um, the money that I have saved so far, I’m just going to throw towards the apartment or whatever. I’m just gonna- I’m gonna worry about that within the first month.

Clark: I mean, I- that’s smart, but at the same time I thought the VanderWaals want nothing right now, and you’re gonna have to get back on their good side, ‘cause I don’t think- I think talking about them is just making the courts and everything mad because they think you’re crazy and that the-

Daniel: Right- to be honest, I really don’t care about what the courts think about me and Grace right now. I really don’t.

Clark: OK.

Daniel: Because, like, they don’t have a say. They’re not really and… [cuts out]

Clark: So… hello?

Daniel: Yup, the Grace situation is not actually in my charges, nothing. I was never given a restraining order form, because there’s no restraining order. What- when I was at court on the very first hearing that I had on my arraignment, they- the judge even said that like, “I don’t care about the VanderWaals.” Like he straight up said that.

Clark: Well, I mean, in other news, did you learn in jail about that um, that hitman that killed that CEO in New York?

Daniel: I did, I did and that is scary.

Clark: Yeah, that’s like the- probably why some big news going around.

Daniel: But also, like I said, I’m deciding I’m just gonna worry about what- like, trying to get out as soon as possible. And my plan is to, like Bob is saying I need somewhere to be. Um, I’m aware of that, I don’t know if the VanderWaals will just meet me at the jail and I will just do whatever they want because I want to focus on me and Grace, and not only that, um, but as well as like what’s going on with the…

Clark: * mutes his mic, to viewers as Daniel continues speaking* Clark, saying I try every time to tell him that Grace is fake. He doesn’t listen. He doesn’t. *unmutes *

Daniel: Um, if I get released and then they’re wanting to hold off for the time being, until I get the apartment, then my best odds is just to try to get out and get the apartment.

Clark: Yeah, no, I mean they- obviously that or a halfway house because they might force you to go to a half-

Daniel: Well, well, here’s another thing. I would have to plead to a deal, like a plea deal to go to a halfway house. And I don’t think that they want to, per the VanderWaals they would want me to plead guilty because I would be pleading guilty to a felony.

Clark: For… I mean I honestly-

Daniel: And if Grace is saying and Tina is saying that like, they don’t want me in and out of jail then it would be best to just try to resolve everything.

Clark: Yeah, but at the same time it’s probably, you gotta focus on yourself too. I get what you’re saying but, I mean, so how are you doing in the Oklahoma Cimarron? Is the food- do they serve food? Do you get to go outside or anything?

Daniel: Right, and I wish I could talk to Tina, I wish I could talk to Grace, I don’t know if that’s something that they are, would be up to at this point. Um, I have no way to check right now, um, but I’m clearly um, wanting to try to figure out that stuff.

Clarkl: Yeah, I mean I can't really help with that right now, ‘cause I don’t have contact either and I pretty much haven’t talked to Bob or anything either, and I don’t want to get everything mixed up, I’m just worried about-

Daniel: Well, yeah, and another thing I don’t get is why everybody is saying that the relationship, the relationship with Grace was never a thing when in my legal discovery I think every single lie from Bob, from like, my biological father, from Dave, from Tina and Grace, including frickin’ *unintelligible *. So I can see every single lie that I- before I even met Grace.

Clark: There were a lot of lies. I mean, there were a lot of lies, so I mean that’s probably why people are trying to doubt it.

Daniel: They’re just trying to- I mean at this point, what the court system is trying to do is they’re trying to sabotage my career, and they’re trying to sabotage my relationship with Grace because they’ve already- I mean they already said I’m the victim and that means from my public defender, and they also said that like, my case should be dropped.

Clark: Dude, I mean I agree that your case should end up being dropped. Uh, also at the old jail, did you ever meet that Jared Fogle?

Woman: *walks into bathroom * Griffin, get your ass out here.

Clark: Oh- *hangs up *
